OVERVIEW

Dan is a partner in the firm’s Litigation and Dispute Resolution Group, where he acts for owners, developers, lenders, contractors, and established and emerging businesses where money, land, or a contract is at stake. He helps clients recover what they are owed, protect what they have built, and resolve disputes efficiently. His approach rests on three priorities: (1) practical and efficient recovery; (2) risk mitigation through proactive issue identification; and (3) maximizing results while minimizing time and expense.

Having joined RBS in 2026 after almost 20 years at a prominent firm in the Fraser Valley, where he served as Managing Partner from 2020 to 2025, he is a director of the Canadian Bar Association, BC Branch, where he chairs the Finance and Audit Committee, and is a past President of the Surrey Bar Association. His work has been recognized by Best Lawyers® in Canada and the Canadian Legal Lexpert Directory.

Dan has appeared at all levels of court in British Columbia, including the Court of Appeal on several occasions, as well as before administrative tribunals and at the Federal Court of Canada. He has been lead counsel on commercial trials of up to 35 days and regularly appears on the applications that shape a dispute early, including injunctions, certificates of pending litigation, security for costs, and summary trials. Many of his matters resolve without trial through early risk assessment, well-chosen interim relief, negotiation, and mediation, and when they do proceed to trial, it is only after early identification of issues, cost and risk assessment, and proactive steps to resolve the matter without proceeding to trial.

Born and raised in B.C., Dan is passionate about family and community. He enjoys time with his wife, two young daughters, and goldendoodle, Finn, as well as running, lifting weights, and travel. He volunteers at community events in South Surrey and White Rock to support his community, and his daughters’ involvement in it.

Dan provides legal services through DATM Law Corporation.

REPRESENTATIVE CLIENT WORK

LITIGATION AND DISPUTE RESOLUTION

Debt Recovery and Sale of Land

Dan acts for lenders, companies, and individuals in recovering debts and enforcing promissory notes, guarantees and indemnities, including by way of summary judgment. He conducts mortgage foreclosures, court-ordered sales after judgment, owner-brought sales under Rule 13-5 of the Rules of Court, and has recovered funds obtained through fraud by obtaining Norwich orders and freezing bank accounts.

Insolvency and Receivership

Dan has both brought and defended receivership applications. For a second-ranking lender, he recently obtained a receivership order that included a sales process order, and an approval of a stalking horse bid, and ultimately approval of the resulting sale by reverse vesting order. Dan advises on restructurings and proceedings under the Bankruptcy and Insolvency Act and the Companies’ Creditors Arrangement Act, and assists buyers in purchasing land through foreclosure or insolvency proceedings.

Commercial/Business Litigation and Shareholder Disputes

He acts in shareholder, partnership, joint venture and has obtained orders under sections 229 and 230 of the Business Corporations Act amending and rectifying corporate articles.

CONSTRUCTION

Construction and Real Estate Disputes

Dan has experience both prosecuting and defending claims of lien under the Builders Lien Act. For local developers, he assists in proactively and efficiently removing claims of lien, defending disputes under the Real Estate Development Marketing Act (REDMA), and resolving land issues such as easements (including crane swing easements), statutory building schemes, and certificates of pending litigation — so that developers can get back to business. He has obtained an order directing the Land Title Office to approve a strata plan amendment to allow for a late amendment to commercial strata for a multi-phased development, and has experience resolving disputes with stratas and with purchasers. He also has experience with various neighbour disputes involving land including boundary disputes, easement disputes, and drainage disputes.

Dan acts for landlords in addressing disputes with tenants, including collections through enforcement proceedings, as well as other contract disputes.
