The New British Columbia Societies Act

As we learned late last year, Charities and Not-for-Profits governed by the BC Society Act now have a date on which they will become subject to the new Societies Act. The new Act comes into force on November 28th 2016. After that date, Societies will have a two-year period to transition to the new legislation.

While nothing needs to be done just yet, it would be prudent for existing Societies to start turning their minds to the new legislation and the transition process. In particular, Societies planning to hold an Annual General Meeting in the coming months may want to consider whether they can be pro-active and prepare for the requirements of the new legislation before it comes into force. Once the new Societies Act comes into force on November 28th, 2016, existing Societies will no longer be able to alter their bylaws before completing the transition process.
