Nicholas W. Peterson Counsel in Courchesne v McComb Witten Marcoux – A Right to an LPA Registrar Review Hearing Confirmed for Fee Disputes Between Competing Law Firms

Two firms disputed a shared contingency fee arising from the same lawsuit and the client took no position on how the fee was to be divided. The issue was whether a Registrar could review the earlier firm’s fee claim or whether the dispute was a private contract disagreement between competing law firms. The Registrar ruled it’s within their authority to hold a Review Hearing under the Legal Profession Act (LPA) to examine the preceding firm’s claimed fee.
 
This decision confirms that under the LPA, the subsequent law firm can challenge the preceding firm’s claimed fee through a Registrar’s LPA Review Hearing to resolve fee disputes tied to the same contingency fee.
