Assistant
Nicole articled with the firm and joined as an associate in the Litigation Department in 2003. She is an essential asset to the firm's Employment Law, Insurance Law, and Commercial Leasing Groups having appeared before all levels of Court in British Columbia, as well as mediation and arbitration hearings. Prior to joining Richards Buell Sutton LLP, Nicole worked in the Legal Services Department of BC Hydro and also extensively with the Insurance Corporation of British Columbia promoting road safety among youth in British Columbia.
Representative Client Work
Employment
Nicole is familiar with advising employers and employees on their rights and obligations, including appropriate severance packages, when employment is terminated. Her client work also includes:
- Drafting employment contracts and documents related to the termination of an employee's service
- Representing both employers and employees in wrongful dismissal actions in the Supreme and Provincial Courts of British Columbia
- Reviewing, assessing and defending or challenging the validity of non-competition agreements
- Handling claims of harassment and discrimination (including on the basis of sex, mental or physical disability, religion or visible minority status) at the Human Rights Tribunal in hearings, dismissal applications and at mediation
- Conducting appeals on behalf of employers at the Employment Standards Tribunal and representing employers' interests at the Employment Standards Branch
- Arguing Employment Insurance appeals before the Umpire
- Conducting WCB Review Division and Appeal Tribunal appeals through both written submissions and oral hearings
Real Estate Litigation
Nicole has a broad experience working with property managers, tenants and landlords handling commercial lease disputes including failure to pay rent, rent distress, abandoned premises, abandoned goods in a premise, surrender agreements, eviction of overholding tenants and ownership of fixtures on premises. Her client work also includes:
- Representing developers, purchasers and sellers in claims arising from the collapsed sales of residential and recreational real estate in British Columbia
- Obtaining orders for sale of property when multiple property owners are involved in a dispute
- Handling litigation related to charges on legal title for properties such as easements
Insurance
Nicole's client work also includes:
- Defending personal injury claims in the Supreme and Provincial Courts of British Columbia and successfully resolving claims including soft tissue injuries, chronic pain and psychological issues
- Conducting or assisting with a variety of property damage cases ranging from first party claims by homeowners resulting from fire and water damage to third party liability claims against logging contractors for forest fires
- Trial experience defending insurance coverage denials where parties have misrepresented their claim values or participated in their own loss. Nicole has successfully demonstrated in trial that an insurer's process for claims handling with a party who was not familiar with the English language was appropriate and consistent. This defeated the insured's allegation he had not understood the claims process
- Involvement with the defence of strata council members facing claims such as breach of duty, breach of contract and negligence claims from strata residents
- Preparing coverage opinions for homeowner and CGL (Commercial General Liability) insurance policies
General Commercial Disputes
- Successfully petitioned the Supreme Court for relief on jurisdictional grounds
- Acting in wide a variety of contract disputes
- Representing companies and shareholders in shareholder disputes, oppression actions, and joint venture disputes
